These Terms of Service are also referred to as our Terms of Use Agreement.
1. Agreement to Terms
These Terms of Service (“Terms”) govern your access to and use of MedSales Network’s website, applications, and services (the “Services”). By creating an account, clicking Continue, or otherwise using the Services, you agree to these Terms and our Privacy Policy.
2. Eligibility & Accounts
- You must be at least 18 years old and able to form a binding contract in your jurisdiction.
- You are responsible for maintaining the confidentiality of your account credentials.
- You agree to provide accurate, current information and keep it updated.
- You may not create multiple accounts to evade limits, misrepresent identity, or abuse platform features.
- You are responsible for activity that occurs under your account.
3. Platform Role
MedSales Network is a matchmaking and communications platform for medical sales hiring. We do not guarantee interviews, offers, hiring outcomes, compensation, or candidate performance. Employers are solely responsible for job postings, hiring decisions, background checks, and compliance with employment, anti-discrimination, and other applicable laws.
Job Seekers (also referred to in employer workflows as Candidates) are responsible for the accuracy of their profiles, applications, and communications.
4. Acceptable Use
You agree not to:
- Use the Services for unlawful, harmful, deceptive, or misleading purposes
- Attempt to access another user’s account or platform systems without authorization
- Scrape, harvest, copy, or collect data from the platform without permission
- Post false information, impersonate others, or misrepresent affiliations or qualifications
- Harass, discriminate against, or send spam or abusive communications
- Circumvent usage limits, billing rules, or security controls
- Use the Services to build a competing database of users or job listings without authorization
5. Subscriptions & Billing
- Some features require a paid subscription for Job Seekers and/or Employers.
- Prices, features, plan limits, and promotional offers may change over time.
- Paid subscriptions may renew automatically unless canceled before the renewal date through your account or payment provider settings, as applicable.
- Except where required by law, fees are generally non-refundable once a billing period has begun. Any stated refund or trial terms will be disclosed at purchase.
- Payments are processed through third-party providers (such as Stripe). We do not store full payment card details.
6. Content & User Data
You retain ownership of content you submit (such as profile information, resumes, job descriptions, messages, and interview materials). You grant MedSales Network a worldwide, non-exclusive license to host, process, reproduce, display, and distribute that content solely to provide, operate, improve, and secure the Services.
You represent that you have the rights to submit your content and that it does not violate third-party rights or applicable law. We may remove content that violates these Terms or creates risk for users or the platform.
7. AI-Assisted Features
The Services may include AI-assisted matching, drafting, interview preparation, analytics, and related tools. Outputs may be incomplete or inaccurate and should be reviewed by you before reliance. AI features are assistive only and do not constitute legal, medical, HR, or employment advice.
Employers remain responsible for evaluating candidates and making hiring decisions. Job Seekers remain responsible for the accuracy of information they submit and share.
8. Messaging & Communications
The Services may allow Job Seekers and Employers to communicate. You are responsible for your communications and agree to use professional, lawful conduct.
Email & Job Alerts
By creating an account or opting into job alerts, you agree that we may send you service-related emails and, where permitted, job alert and promotional emails. You can manage preferences in your account settings or through unsubscribe links included in messages. See our Privacy Policy for more detail.
SMS Notifications
Users may voluntarily opt in to receive SMS notifications by enabling SMS notifications within their account settings and providing a valid mobile phone number.
By enabling SMS notifications, you provide prior express written consent to receive recurring automated text messages (including SMS and MMS) from MedSales Network sent through an automatic telephone dialing system, regarding:
- Account activity and security alerts
- Job matches and candidate communications
- Employer communications
- Platform updates and service notifications
- Promotional and marketing messages, where permitted and subject to your preferences
Message frequency varies based on your account activity and communication preferences. Message and data rates may apply.
Consent to receive text messages is not a condition of purchasing any services or subscriptions.
You may revoke consent at any time by replying STOP to any message or by disabling SMS notifications in your account settings. For assistance, reply HELP or contact support@medsalesnetwork.global.
You represent that you are the authorized user or subscriber of the mobile number provided and agree to notify MedSales Network promptly of any changes to your number.
MedSales Network and participating carriers are not liable for delayed or undelivered messages.
We maintain electronic records of user opt-in and opt-out activity, including timestamps and consent disclosures, for compliance and legal protection purposes.
9. Employer Job Postings
Employers are responsible for the accuracy and legality of job postings, compensation representations, and hiring practices. Postings must not discriminate unlawfully or mislead applicants. We may remove or restrict postings that violate these Terms or applicable law.
10. Termination
We may suspend or terminate accounts that violate these Terms, create risk for the platform or other users, or as required by law. You may stop using the Services at any time and may request account deletion through your account settings or by contacting support.
11. Disclaimers
The Services are provided “as is” and “as available.” To the fullest extent permitted by law, we disclaim warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Services will be uninterrupted, error-free, or free of harmful components.
12. Limitation of Liability
To the maximum extent permitted by law, MedSales Network and its affiliates, officers, employees, and agents will not be liable for indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, goodwill, or business opportunities arising from your use of the Services.
Our total liability for any claim relating to the Services will not exceed the greater of (a) the amount you paid us in the twelve (12) months before the event giving rise to the claim or (b) one hundred U.S. dollars (US $100), except where such limitation is prohibited by law.
13. Indemnification
You agree to defend, indemnify, and hold harmless MedSales Networkand its affiliates from claims, damages, losses, and expenses (including reasonable attorneys’ fees) arising from your content, your use of the Services, your hiring or job-seeking activity, or your violation of these Terms or applicable law.
14. Governing Law & Disputes
These Terms are governed by the laws of the State of Delaware, USA, without regard to conflict-of-law principles, except where mandatory local consumer protection laws apply. Any dispute arising from these Terms or the Services will be brought in the state or federal courts located in Delaware, unless applicable law requires otherwise.
If your organization requires a different governing law or venue for enterprise agreements, contact us to discuss a separate written agreement.
15. Changes to These Terms
We may update these Terms from time to time. The “Last updated” date reflects the most recent version. Material changes may be communicated through the Services or by email where appropriate. Continued use of the Services after changes take effect means you accept the updated Terms.
